EMPLOYMENT BASED GREEN CARD

A US employer files a petition for a foreign national to become a permanent resident

The US employer-sponsor has to offer a full-time, permanent employment. The alien must meet the minimum requirements for the job, the employer must be able to pay the alien's salary and the alien and employer must both intend for the alien to undertake the position.

The department of labor must certify that US workers qualified for the job being offered are unavailable to fill the position.

There are several employment-based preferences:

1. The first employment based preference is for priority workers:
* Managers and executives subject to international transfer to the United States (no labor certification required)
* Outstanding professors and researchers with universities or private employers that have established research departments (no labor certification required)
* Alien of "extraordinary ability" in the sciences, arts, education, business and athletics.(no labor certification required, no offer of employment required)

2. The second employment-based preference:
* Alien of "exceptional ability" in the sciences, arts, or business
* Advance degree professionals

A labor certification is required as well as a job offer except if the job offer requirement is waived by INS in the national interest.

3. The third employment-based preference:
* Professionals with bachelor's degrees not qualifying in the second preference
* Skilled workers (filing positions requiring at least 2 years of training and experience)
* Unskilled workers

A labor certification is required as well as an offer of employment.
